Cheney claims VP is NOT part of the executive branch of Fed. Gov't.?

VP Cheney says he need not comply with an execute order on safeguarding clified information because he is part of the legislative branch of the Federal government. Do you agree? Why are why not? What does the Bible say about this, if anything?
